North Dakota Law
North Dakota's medical marijuana program was established by voter-approved Measure 5 (North Dakota Compassionate Care Act) in 2016 and became operational in 2018. The program is regulated by the North Dakota Department of Health and Human Services. Patients with qualifying medical conditions can receive certification from licensed healthcare providers and purchase medical cannabis from state-licensed dispensaries.
- Patients must be North Dakota residents.
- Non-residents with valid out-of-state medical marijuana cards can apply for 60-day temporary cards effective August 2025.
- Physicians, physician assistants, and advanced practice registered nurses can certify patients.
- Cannabis is available only through eight licensed dispensary locations statewide.
- Home cultivation of weed is strictly prohibited with no exceptions for patients or caregivers.
- Registered patients may designate up to five caregivers; caregivers may assist up to five patients each.
- Smoking cannabis requires special certification from physician; otherwise patients use non-combustible forms.
- Driving under the influence of cannabis is illegal.
- Recreational cannabis is illegal.

North Dakota Possession Limits
North Dakota establishes possession and purchase limits based on product type, with enhanced limits available for cancer patients.
- Standard patients may possess up to 3 ounces of cannabis at any time.
- Standard patients may purchase up to 2.5 ounces of dried flower per 30-day period.
- Cancer patients with enhanced authorization may purchase up to 6 ounces per 30-day period.
- Patients may purchase up to 6,000 mg of THC in concentrates or medical products per 30-day period.
- Edible products limited to 5 mg THC per serving, 50 mg per package, with 310 mg daily purchase limit.
- Minors (under 19) limited to pediatric medical marijuana and cannot use dried flower.
- Caregivers may possess the allowable amount for each registered patient they assist.
- Cannabis must be stored in original dispensary containers and kept in enclosed, locked facilities.
- Home cultivation is not allowed.
